What is the Membership Year?

The membership year for Pickleball Ontario and Pickleball Canada is from January 1 to December 31. If you register on September 1 or later of any year, your membership will run to December 31 of the following year.

Please note that Pickleball Ontario and Pickleball Canada membership fees are NON-REFUNDABLE. Ensure that you are joining the correct Member Club and that you are aware of their membership fees and costs prior to completing your registration.

1. PARTIES ET DÉFINITIONS

À : L'ORGANISATION PICKLEBALL CANADA (une organisation à but non lucratif constituée en vertu des lois fédérales), ses organisations provinciales et territoriales affiliées, ses associations et clubs membres locaux, ainsi que leurs administrateurs, dirigeants, employés, entraîneurs, instructeurs, agents, représentants et bénévoles respectifs (collectivement, les « renonciataires »). Cette décharge ne s'étend pas aux entrepreneurs indépendants, sous-traitants, sponsors ou propriétaires/exploitants d'installations, sauf s'ils agissent sous la supervision et le contrôle directs de l'organisation Pickleball Canada.


Les ACTIVITÉS 
comprennent : la participation ou la présence à des entraînements, des formations, des cours, des stages, des ateliers de perfectionnement, des sélections, des ligues, des tournois, des compétitions, des événements, des séances d'orientation, des réunions, des démonstrations, des activités sociales, du bénévolat, de l'arbitrage, de l'administration, l'utilisation d'installations et d'équipements, et les déplacements connexes.


2. ACCEPTATION DES RISQUES

Je reconnais que la participation au pickleball et aux activités connexes comporte des risques inhérents et prévisibles, notamment :

  1. Collision avec des personnes ou des objets

  2. Être frappé par des raquettes, des filets, des poteaux ou des balles

  3. Effort excessif, déshydratation, accidents cardiovasculaires

  4. Blessures corporelles (entorses, fractures, blessures aux yeux, lésions cérébrales, lésions de la moelle épinière, décès)

  5. Perte d'équilibre, glissades, trébuchements, chutes

  6. Premiers secours inadéquats ou défauts de l'équipement

  7. Négligence ordinaire de la part des renonciataires dans la conduite des activités, à l'exclusion de la négligence grave, de la faute intentionnelle ou du mépris imprudent de la sécurité des participants

J'ACCEPTE LIBREMENT ET ASSUME PLEINEMENT TOUS CES RISQUES ET LA POSSIBILITÉ DE BLESSURES CORPORELLES, DE DÉCÈS OU DE DOMMAGES MATÉRIELS.


3. RENONCIATION ET ABANDON DE DROITS


En contrepartie de l'autorisation qui m'est donnée de participer, j'accepte :


3.1 RENONCER ET LIBÉRER 
les renonciataires de toute réclamation pour toute perte, tout dommage, toute blessure ou tout décès résultant de ma participation et causé par une négligence ordinaire des renonciataires, à l'exclusion des réclamations résultant d'une négligence grave, d'une faute intentionnelle, d'une insouciance imprudente pour la sécurité, d'un manquement aux obligations légales ou de violations de la législation sur la protection des consommateurs.


3.2 INDEMNISER 
les renonciataires contre toute réclamation de tiers résultant de ma propre négligence ou de mon comportement intentionnel pendant ma participation, à l'exclusion de toute indemnisation pour les réclamations résultant de la négligence, du manquement à une obligation ou du non-respect des conditions de sécurité des renonciataires.


3.3 EFFET CONTRAIGNANT 
- Dans la mesure permise par la loi, le présent accord lie mes héritiers, exécuteurs testamentaires, administrateurs et représentants personnels, sauf si cet effet contraignant est contraire à l'ordre public ou aux lois applicables en matière de succession.


4. DISPOSITIONS SPÉCIFIQUES À LA JURIDICTION

4.1 RÉSIDENTS DE LA COLOMBIE-BRITANNIQUE - DISPOSITIONS SPÉCIALES


POUR LES MINEURS : 
Si le participant est âgé de moins de 19 ans (âge de la majorité en Colombie-Britannique), le parent/tuteur reconnaît :

  • • J'ai lu et expliqué le présent accord au mineur

  • • Je consens à la participation du mineur

  • • J'accepte les risques au nom du mineur uniquement dans la mesure permise par la loi de la Colombie-Britannique

  • • Je reconnais que je ne peux renoncer au droit indépendant du mineur d'intenter une action en justice lorsqu'il atteindra l'âge de la majorité, et que la présente renonciation ne vise pas à le faire

  • • Mes obligations d'indemnisation ne concernent que ma propre conduite, et non les droits indépendants du mineur

4.2 RÉSIDENTS DU QUÉBEC - RESTRICTIONS IMPORTANTES

PROTECTIONS JURIDIQUES AU QUÉBEC : Pour les activités au Québec ou régies par la loi du Québec :


RECONNAISSANCE DES RISQUES : 
L'acceptation des risques constitue une reconnaissance des risques prévisibles et un accord de participation malgré ceux-ci.


LIMITATIONS DE RESPONSABILITÉ : 
Toute décharge ou indemnisation prévue dans le présent accord :

  • • N'EXCLUT PAS la responsabilité en cas de blessures corporelles, de décès ou de préjudice moral causés par une faute intentionnelle ou une faute grave (faute lourde), et toute exclusion de ce type est nulle et non avenue en vertu des articles 1474 et 1475 du Code civil du Québec

  • • N'EXCLUT PAS la responsabilité qui ne peut être levée en vertu du Code civil du Québec ou de la Loi sur la protection du consommateur

JURIDICTION : Le droit québécois s'applique et les tribunaux québécois ont compétence pour les activités au Québec.

4.3 AUTRES PROVINCES ET TERRITOIRES

Pour les activités en dehors de la Colombie-Britannique et du Québec, la loi applicable et la juridiction compétente seront les suivantes :

  • • La province/le territoire où l'activité a lieu, ou

  • • Si l'activité se déroule à l'extérieur du Canada, la juridiction où l'activité se déroule

  • • La Cour fédérale du Canada pour les questions relevant de la compétence exclusive du gouvernement fédéral, sous réserve des lois provinciales applicables en matière de protection des consommateurs et de limitation de la responsabilité.


5. DISPOSITIONS GÉNÉRALES

5.1 DIVISIBILITÉ : Si une disposition du présent Contrat est jugée invalide, illégale ou inapplicable, cette disposition sera supprimée et les autres dispositions resteront pleinement en vigueur dans toute la mesure permise par la loi. Toutefois, si la disposition invalide est fondamentale pour l'objet du Contrat, l'ensemble du Contrat peut être nul.


5.2 APPLICATION MAXIMALE : 
Le présent Contrat sera appliqué dans toute la mesure permise par la loi applicable dans chaque juridiction.


5.3 MISES À JOUR SPÉCIFIQUES À LA JURIDICTION : 
Les renonciataires peuvent fournir des avenants supplémentaires spécifiques à la juridiction afin de garantir la conformité locale.


5.4 INTÉGRALITÉ DE L'ACCORD : Le présent accord constitue l'intégralité de l'accord entre les parties concernant l'objet des présentes. Toutefois, cette disposition n'exclut pas la responsabilité en cas de fausse déclaration frauduleuse ou de fausses déclarations incitant à la conclusion 
du présent accord.


6. RECONNAISSANCE ET SIGNATURE


J'AI LU ET COMPRIS LE PRÉSENT CONTRAT. J'AI EU SUFFISAMMENT DE TEMPS POUR L'EXAMINER ET DEMANDER UN AVIS JURIDIQUE INDÉPENDANT SI JE LE SOUHAITAIS. JE SAIS QUE JE RENONCE À CERTAINS DROITS LÉGAUX QUE MOI-MÊME OU MES REPRÉSENTANTS POURRIONS AVOIR À L'ENCONTRE DES RENONCIATAIRES, SOUS RÉSERVE DES LIMITATIONS ÉNONCÉES DANS LE PRÉSENT CONTRAT.

Release of liability, Terms and Conditions,

Assumption of risks and indemnity agreement for Pickleball Ontario

(hereinafter referred to as the “Release Agreement”)

By agreeing to this document, you will waive or give up certain legal rights, including the right to sue or claim compensation following transmission of a communicable disease or an accident

Please read carefully!

TO: PICKLEBALL ONTARIO associations, clubs and their respective directors, officers, employees, instructors, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors and assigns (hereinafter collectively referred to as the “Releasees”).

ASSUMPTION OF RISKS

I am aware that participating in the sport of pickleball involves many risks, dangers and hazards including, but not limited to: the transmission of a communicable disease, including but not limited to COVID-19; collision with other persons or objects; being struck by a paddle; being hit by a ball; the risk of stroke, heart attack or other similar life threatening conditions caused by physical exertion; the risk of personal injury including, but not limited to, strains, sprains, fractures, brain injury, spinal cord injury including paraplegia or quadriplegia, or death; loss of balance or control; slips, trips and falls; negligent first aid; failure to act safely or within one’s own ability; negligence of other persons; and, negligence on the part of the releasees. I understand that negligence includes failure on the part of the releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards referred to above. I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, or property damage or loss resulting therefrom.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the Releasees accepting my application for membership in Pickleball Ontario and, as applicable, my local association or club, and permitting my use of the facilities and premises provided by the Releasees (hereinafter “the premises”), I hereby agree as follows:

  1. To waive any and all claims that I have or may in the future have against the releasees, and to release the releasees from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, as a result of my participation in the sport of pickleball including, but not limited to, my use of the premises due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under any provincial occupiers’ liability legislation on the part of the releasees. I understand that negligence includes the failure on part of the releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards referred to above.
  2. To hold harmless and indemnify the releasees from any and all liability for any damage to property of or personal injury to any third party, resulting from my use of or presence on the premises.
  3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
  4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario.
  5. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province Ontario.

In entering into this Release agreement, I am not relying upon any oral or written representations or statements made by the Releasees with respect to the safety of pickleball other than what is set forth in this Agreement.

I have read and understand this release agreement and I am aware that by agreeing I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns and representatives may have against the releasees.

OLPC Membership Sports Waiver

Membership Sports Waiver

Oakville Lynx Pickleball Club hereinafter referred to as OLPC.

PLEASE READ CAREFULLY BEFORE SIGNING. Completed waivers must be signed and returned prior to first attending any of OLPC’s events (collectively an “Event”) including any event related to the sport of pickleball, practices, training, games, on-court or off-court events, programs and/or activities organized, operated, conducted or sanctioned by OLPC. This waiver applies to each Event whether occurring in the near or distant future, and each of the Participant and the Participant’s Guardian agrees that the terms of this waiver need not be brought to the attention of the Participant or the Participant’s Guardian each time the Participant participates in an event in order for it to be effective.

COVID 19: I, the undersigned, declare that:

● Have not travelled internationally during the last 14 days;

● Have not visited a COVID-19 high risk area, region or location in Canada during the last 14 days;

● Do not knowingly have COVID-19;

● AM not experiencing known symptoms of COVID-19, such as fever, cough, or shortness of breath, and if experiences such symptoms during the Event will immediately depart from the Event;

● Have not, in the past 14 days, knowingly come into contact with someone who has COVID-19, who has known symptoms of COVID-19, or is self-quarantining after returning to Canada; and

● Follow government recommended guidelines in respect of COVID-19, including practicing physical distancing, and will do so to the best of my ability during the Event.

In addition, by signing below I understand, acknowledge and assume

the inherent risks in participating in the Event, including, but not limited to: the potential for bodily injury or illness (including contraction of COVID-19); contact or interaction with others who may have been exposed to COVID-19; permanent disability, paralysis, or loss of life; collision with natural or manmade objects; dangers arising from adverse weather conditions; imperfect venue or field of play conditions; equipment failure; participants of varying skill levels; inadequate safety measures; circumstances known, unknown or beyond the control of OLPC, its partners, sponsors, agents, affiliates, directors, employees, officer, therapists, coaches, or volunteers (together, OLPC); negligence or omission of OLPC (collectively, the “Risks”)

Health Declaration: I, the undersigned, declare that I am physically fit and have no known medical conditions or impairments that may affect my ability to participate in pickleball activities. I acknowledge that it is my responsibility to consult a medical professional if I have any concerns about my health and fitness for participation.

Medical Authorization: In the event of an injury or medical emergency, I authorize OLPC and its representatives to obtain necessary medical treatment for me. I understand that I am responsible for any medical expenses incurred as a result of such treatment.

Waiver of Liability: I, on behalf of myself, my heirs, assigns, and next of kin, waive, release, and discharge OLPC, its directors, officers, volunteers, coaches, and affiliates from any liability for injuries, damages, or losses sustained as a result of my participation in club activities, including but not limited to accidents, falls, equipment failure, or negligence.

Image Release Permission: I grant OLPC permission to take and use photographs, videos, or other media featuring my image for promotional, marketing, or educational purposes. I understand that these images may be used in club materials, social media, or other publications without compensation.

Disclosure Statement: I acknowledge that I have been provided with information regarding the risks associated with participation in pickleball activities. I confirm that I have read and understood this waiver and have been given an opportunity to ask questions before signing.

Assumption of Risk: I acknowledge that participation in pickleball involves inherent risks, including but not limited to falls, collisions, muscle strains, and other physical injuries. I voluntarily assume all risks associated with my participation and agree to abide by all club rules and safety guidelines.

Age Restriction: Participants must be 18 years of age or older to sign this waiver. If the participant is under the age of 18, they must communicate with their parent or legal guardian and receive their guidance and consent before participating in any club activities. A parent or guardian must also sign this waiver on their behalf.

Jurisdiction: I agree that in the event that I file a lawsuit against OLPC, I agree to do so solely in the province of Ontario, Canada and further agree that the substantive law of Ontario will apply without regard to conflict of law rules. I further agree that if any portion of this Agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

I have read and understood the health declaration, medical authorization, waiver of liability and disclosure statement as listed above.

OLPC Membership Terms and Conditions

Oakville Lynx Pickleball Club hereinafter referred to as OLPC.

1. Membership Eligibility

1.1 General Requirements

Membership in OLPC is open to individuals who support the objectives of OLPC and agree to abide by its rules, regulations, and Code of Conduct. OLPC reserves the right to approve or reject any membership application at its sole discretion, without obligation to provide justification.

1.2 Age Restrictions

Individuals must be at least 18 years of age to register independently.

Individuals under the age of 18 may participate only with the written consent and active involvement of a parent or legal guardian.

For minors, the guardian must complete and sign all required waivers and health declarations on behalf of the minor.

1.3 Application Process

All prospective members must:

Complete the official Membership Registration Form in full;

Read and agree to the Terms and Conditions, including the Membership Sports Waiver;

Provide any required documentation (e.g., identification, proof of age for minors, health information);

Pay the applicable membership fees in full prior to activation.

1.4 Application Process

Membership becomes active only upon:

● Review and approval of the application by OLPC’s Board or Membership Committee;

● Full payment of applicable fees;

● Receipt of all signed waivers and consent forms.

1.5 Right to Deny or Revoke Membership

OLPC reserves the right to deny or revoke membership for reasons including, but not limited to:

Submission of false or incomplete information;

Violation of OLPC rules, Code of Conduct, or governing policies;

Conduct that brings OLPC into disrepute or poses a risk to members;

Non-compliance with health and safety regulations.

2. Code of Conduct

The Code of Conduct outlines the expected behavior of all members, guests, volunteers, coaches, and staff involved in Club activities. The goal is to ensure a welcoming, respectful, inclusive, and safe environment for all participants regardless of skill level, age, background, or affiliation.

2.1 Respect and Sportsmanship

All members must:

Treat fellow players, opponents, referees, coaches, volunteers, and spectators with respect at all times.

Demonstrate fair play, honesty, and integrity during all Club activities.

Use appropriate language and avoid offensive, threatening, discriminatory, or inflammatory remarks.

Accept both victory and defeat with dignity and grace in competition.

2.2 Zero Tolerance for Harassment or Discrimination

OLPC enforces a strict zero-tolerance policy against any form of:

Bullying, harassment, or intimidation (verbal, physical, or psychological)

Discrimination based on race, gender, age, disability, sexual orientation, religion, or national origin

Sexual harassment or misconduct Violations may result in immediate suspension or termination of membership.

2.3 Behavior During Club Activities

Members must: Follow all facility rules and instructions provided by Club staff or venue personnel.

Refrain from intentionally causing damage to equipment, courts, or property.

Wear appropriate athletic attire and non-marking shoes.

Refrain from bringing unauthorized guests or using courts without proper booking, where applicable.

2.4 Health and Safety

Members are responsible for their own health and fitness level and should not participate if feeling unwell or injured.

All injuries or incidents must be reported immediately to OLPC organizers or designated safety officers.

Members must comply with all public health guidelines or safety protocols in place, including hygiene or distancing measures if applicable.

2.5 Conflict Resolution

Any disputes or disagreements should be resolved amicably and respectfully.

If necessary, concerns may be submitted to OLPC's Board or Conflict Resolution Committee in writing.

Retaliation against any member who raises a concern in good faith is strictly prohibited.

2.6 Conflict Resolution

Members are expected to represent OLPC positively in public and on social media.

Any photos, videos, or statements posted publicly that mention or depict OLPC, its members, or events must reflect OLPC’s values of inclusivity and respect.

Defamatory, misleading, or offensive content related to OLPC may result in disciplinary action.

2.7 Consequences of Misconduct

Violations of this Code of Conduct may result in:

Verbal or written warnings

Temporary suspension from Club activities

Permanent revocation of membership, with no refund of fees

Notification of local authorities if the conduct violates any laws

All decisions regarding disciplinary actions will be made by OLPC’s Board or a designated Conduct Review Panel and are final.

3. Suspension and Termination of Membership

3.1 Grounds for Suspension or Termination

OLPC reserves the right to suspend or terminate a membership at any time for reasons including, but not limited to:

Breach of OLPC’s Terms & Conditions or Code of Conduct;

Non-payment of membership or event fees;

Repeated absences from scheduled activities without notice;

Disruptive or unsafe behavior toward other members or staff;

Any actions that bring OLPC into disrepute.

3.2 Disciplinary Process

Where possible, members will be given: A written notice describing the nature of the violation; An opportunity to respond or clarify; A chance to correct the issue (except in cases of severe misconduct).

3.3 Disciplinary Process

OLPC may terminate membership immediately and without refund if:

A member engages in violence, harassment, or illegal activity;

The safety or wellbeing of other members is at risk.

3.4 Appeals

Members may appeal a suspension or termination by submitting a written request to the Board within 7 days of notice. Appeals will be reviewed by OLPC’s leadership, whose decision is final.

4. Media Release and Photography Consent

4.1 Club Media Use

By becoming a member, you grant OLPC permission to use photographs, videos, or recordings taken during club events or activities for:

Promotional materials;

Social media posts;

Newsletters and email communications;

Website content.

4.2 External Media

OLPC is not responsible for images taken and published by third parties (e.g., spectators, guests, other members) unless under official Club channels.

5. Health Declaration

5.1 Fitness to Participate

All members acknowledge that:

They are in good health and physically able to participate in Club activities;

They are responsible for monitoring their own physical condition during play;

They will refrain from participating if they are unwell, injured, or otherwise unable to safely engage in sport. 

5.2 Disclosure of Medical Conditions

Members must inform OLPC of any health conditions that may require special accommodations or emergency responses. All disclosed medical information will be kept confidential.

5.3 Emergency Consent

In the event of a medical emergency where a guardian is not present, OLPC has permission to:

Call emergency services;

Provide basic first aid;

Notify emergency contacts listed on the registration form.

6. Privacy Policy

6.1 Data Collection and Use

OLPC collects personal information solely for:

Registration and communications;

Scheduling and organizing club activities;

Emergency contact and health safety purposes.

6.2 Access and Correction

Members may request access to their personal data and correct any inaccuracies by contacting OLPC’s administrative team.

7. Governing Law and Dispute Resolution

7.1 Jurisdiction

These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada, where applicable.

7.2 Dispute Resolution

Any disputes, concerns, or complaints shall first be addressed internally by submitting a written notice to OLPC’s Board.

The Board will review the matter in good faith and may involve a neutral third party, if needed.

If resolution is not achieved internally, legal action may be taken under Ontario’s applicable dispute resolution laws.

7.3 Severability Clause

If any portion of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Third-Party Payment Processing

8.1 Use of Third-Party Services

All payments made through OLPC’s Jotform website are processed by an independent third-party service provider (e.g., PayPal, Stripe, etc.). OLPC does not store or have access to your full credit card details.

8.2 No Liability for Third-Party Services

OLPC is not responsible for any errors, delays, security breaches, failed transactions, or financial loss resulting from the use of a third-party payment processor. Any issues or disputes related to payment processing should be directed to the third-party provider in accordance with their terms and conditions. You acknowledge that you use such services at your own risk. By submitting payment, you agree to comply with the payment processor’s terms of use and privacy policy.
