A: PICKLEBALL CANADA ORGANIZATION, et ces provinces et territoires et ces représentants locaux et clubs, et leurs dirigeants, agents, employés, instructeurs, représentants, bénévoles, contractuels indépendants, sous-traitants, commanditaires, successeurs et bénéficiaires (ci-après les « Renonciataires »)

ACCEPTATION DE RISQUES

En signant cette entente, je reconnais que je suis, par la présente, informé ou que j’ai été informé que ma participation dans le sport de pickleball implique plusieurs risques et dangers habituels, fréquents et raisonnablement prévisibles et qui sont inhérent à ce sport, incluant, mais pas limité à : des collisions avec d’autres personnes ou objets; le risque de se faire frapper par une raquette, de se faire frapper par une balle; le risque d’accident vasculaire cérébral, les risques cardiovasculaires ou autres conditions qui peuvent menacer la vie causé par l’exercice physique, le risque de blessure personnelle incluant, mais pas limité à, des coupures, des égratignures, des contusions ou autres lésions, entorses, foulures, fractures, lésions cérébrales tel que les commotions cérébrales ou autres traumas crâniens, blessures à la colonne vertébrale, incluant la paraplégie ou tétraplégie ou la mort; dommage à ou perte de vision; perte d’équilibre ou de contrôle; des chutes; et un manquement de se comporter prudemment ou dans les limites de ses propres capacités.

J’ACCEPTE LIBREMENT ET ASSUME EN ENTIER TOUT RISQUE ET DANGER HABITUEL ET RAISONNABLEMENT PRÉVISIBLE INHÉRENT AU SPORT DE PICKLEBALL ET LA POSSIBILITÉ DE PERTE DE VIE, PRÉJUDICE PERSONNEL OU DOMAGE OU PERTE MATERIELLE. DÉCHARGE DE RESPONSABILITÉE, RENONCIATION DE RECLAMATION ET ENTENTE D’INDEMNITÉ

Comme condition d’acceptation de ma demande d’adhésion dans l’organisation Pickleball Canada par les Renonciataires et, tel qu’applicable, ma province/territoire et association locale ou club, et en me permettant d’utiliser les installations et locaux fournis par les Renonciataires (ci-après les « locaux »), je conviens comme suite :

1. DE RENONCER TOUTE RECLAMATION que j’aurais contre un ou des Renonciataires et de décharger les Renonciataires de toute responsabilité pour tout dommage, perte ou préjudice matériel, ou frais que je pourrais engager ou que mes parents proches, héritiers ou testamentaires pourraient engager comme conséquence de la réalisation de tout risque prévisible, normal et habituel qui est en lien avec ma participation dans le sport de pickleball, sauf en raison de la faute intentionnelle ou faute lourde des Renonciataires (ou un des Renonciataires).

2. QUE, si je subi un préjudice corporel ou moral en conséquence de ma participation dans le sport de pickleball et que ce préjudice n’est pas une conséquence de la réalisation d’un risque habituel et raisonnablement prévisible qui est inhérent au sport de pickleball, ma connaissance des risques et dangers expliqués et dénoncés dans cette entente pourrait être considéré comme une faute commune de ma part et que ma responsabilité pourrais, par conséquence, être engagé dans la partage de responsabilité pour tout préjudice que je subi si j’intente des procédures judiciaires contre un ou des Renonciataires;

3. DE DÉGAGER DE RESPONSABILITÉ ET D’INDEMNISER LES RENONCIATAIRES de toute responsabilité pour tout préjudice matériel, corporel ou moral causé à une tierce partie en conséquence de mon utilisation ou présence dans les locaux;

4. Cette entente sera effectif et exécutoire et lie mes héritiers, testamentaires, administrateurs, cédants et représentants en cas de mon décès ou mon incapacité;

5. Cette entente et tout droit, devoir et obligation entre les parties de cette entente sera régi par et interprété conformément avec les lois en vigueur dans la province de l’Ontario seulement; et

6. Tout litige entre les parties de cette entente sera entendu dans la province de l’Ontario et exclusivement devant les tribunaux civils de la province de l’Ontario.

En signant cette entente, je ne me fie pas sur toute représentation orale ou écrite ou des déclarations faites par les Renonciataires concernant la sécurité du sport de pickleball sauf celles exprimées dans cette entente.

Release of liability, Terms and Conditions,

Assumption of risks and indemnity agreement for Pickleball Ontario

(hereinafter referred to as the “Release Agreement”)

By agreeing to this document, you will waive or give up certain legal rights, including the right to sue or claim compensation following transmission of a communicable disease or an accident

Please read carefully!

TO: PICKLEBALL ONTARIO associations, clubs and their respective directors, officers, employees, instructors, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors and assigns (hereinafter collectively referred to as the “Releasees”).

ASSUMPTION OF RISKS

I am aware that participating in the sport of pickleball involves many risks, dangers and hazards including, but not limited to: the transmission of a communicable disease, including but not limited to COVID-19; collision with other persons or objects; being struck by a paddle; being hit by a ball; the risk of stroke, heart attack or other similar life threatening conditions caused by physical exertion; the risk of personal injury including, but not limited to, strains, sprains, fractures, brain injury, spinal cord injury including paraplegia or quadriplegia, or death; loss of balance or control; slips, trips and falls; negligent first aid; failure to act safely or within one’s own ability; negligence of other persons; and, negligence on the part of the releasees. I understand that negligence includes failure on the part of the releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards referred to above. I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, or property damage or loss resulting therefrom.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the Releasees accepting my application for membership in Pickleball Ontario and, as applicable, my local association or club, and permitting my use of the facilities and premises provided by the Releasees (hereinafter “the premises”), I hereby agree as follows:

  1. To waive any and all claims that I have or may in the future have against the releasees, and to release the releasees from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, as a result of my participation in the sport of pickleball including, but not limited to, my use of the premises due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under any provincial occupiers’ liability legislation on the part of the releasees. I understand that negligence includes the failure on part of the releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards referred to above.
  2. To hold harmless and indemnify the releasees from any and all liability for any damage to property of or personal injury to any third party, resulting from my use of or presence on the premises.
  3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
  4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario.
  5. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province Ontario.

In entering into this Release agreement, I am not relying upon any oral or written representations or statements made by the Releasees with respect to the safety of pickleball other than what is set forth in this Agreement.

I have read and understand this release agreement and I am aware that by agreeing I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns and representatives may have against the releasees.

Pickleball Brantford Code of Conduct

All members of Pickleball Brantford agree to play the game with the upmost respect and consideration for other players and the environment.

Specifically, all members of Pickleball Brantford agree to the following:

  • I will always exhibit good sportsmanship and encourage others to do the same.
  • I will always conduct myself in a manner that promotes the health, safety, and well-being of others.
  • I will always use language and actions that are positive, encouraging, and supportive.
  • I will exhibit fairness and honesty in all dealings with others.
  • I will be a positive role model for others learning the game.
  • I will take an active role as an ambassador for Pickleball Brantford in promoting the game as a fun activity for all ages.

Pickleball Brantford Etiquette Rules

ALL MEMBERS: Please read and follow all the “Pickleball Brantford Court Etiquette Rules”.

  1. Good sportsmanship is mandatory.
  2. Respect all players.
  3. Do your best to ensure equitable court time for all members.
  4. Always begin a game by introducing yourself, especially if there is a player or player(s) that you do not know.
  5. If you are open to game improvement suggestions from your partner, please mention that to your partner. Try to avoid offering unsolicited tips to your playing partners.
  6. Call out the score loudly before you serve.
  7. Wait until everyone is ready before you serve.
  8. NEVER yell at, swear at, or say a hostile or sarcastic word to your partner or your opponent, especially in anger.
  9. Hit to both players on the court (don’t single one player out) – everyone wants to take part in the match.
  10. Don’t exploit someone’s physical limitations just so you can “win.” It is not cool!
  11. Only call balls on your side of the net. Not on the other side.
  12. If you and your partner cannot determine if the ball was in or out – or if you disagree with your partner on a line call – the benefit of the doubt goes to your opponent.
  13. If you step into the kitchen on a volley, or if your partner does, call it on your team.
  14. Don’t celebrate when your opponent makes an error.
  15. Don’t over celebrate when you or your partner make a great play.
  16. If you hit a ball into another court, immediately yell “Ball”. Do not enter another court to retrieve your ball unless invited to do so.
  17. When somebody inadvertently hits a ball onto your court from an adjacent court, retrieve it, make eye contact with someone from that court and then directly tap the ball towards them. Do not hit the ball back into their court without looking.
  18. If you are the weakest player on the court, appreciate the time that the other players have spent with you. However, do not take advantage of their graciousness by staying on the court with them for an indefinite period of time.
  19. If you are asked to play with a group that is of a lower skill level than you, graciously accept and play a game with them. They will likely appreciate your graciousness and understand that you may want to get back to similarly skilled players after the game.
  20. If you are obviously the strongest person in your foursome, tone down the competitiveness and hit balls to your opponents that they can return. Work on a new skill – perhaps it is a great time for work on that third shot drop shot.
  21. Thank the opponents for the game.
  22. Do not cross the court behind a match until play has stopped. It’s not only a distraction, but it can be very dangerous as well.

Pickleball Brantford Refund Policy

You have the right to cancel your Pickleball Brantford membership within 14 days of receiving a confirmation communication of acceptance of your application, without providing a reason.

There is a $20 + surcharges for Pickleball Canada & Pickleball Ontario insurance fee which is non-refundable.

After this period, partial or full reimbursements will only be available to Members who the

Pickleball Brantford Board of Directors deem have exceptional mitigating circumstances forcing them to cancel their membership.

Pickleball Brantford Assumption of Risk, Waiver of Claims and Release of Liability Agreement

ACTIVITIES

I am participating or volunteering in the activities, programs, classes, services or events (collectively the “Activities”) sponsored or organized by the Pickleball Brantford (“PBB”). I agree that the PBB and its Directors, Officers, employees, coaches, volunteers, officials, participants, agents, sponsors, organizers, owners/operators of the facilities in which the Activities take place, (collectively the “Organization”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind that I suffer during or as a result of participating or volunteering in the Activities and/or when caused by the negligence of the Organization.

When you are a volunteer who is younger than 18 years old, your parent/guardian must acknowledge and agree to the terms described in this document on your behalf and references in this document to you agreeing to or acknowledging a risk or term is understood to be referring to your parent/guardian agreeing to or acknowledging the risk or term on your behalf.

RISKS

The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis, and loss of life. These risks include:

  • Health: executing strenuous and demanding physical techniques; physical exertion; overexertion; stretching; dehydration; fatigue; cardiovascular workouts; rapid movements and stops; lack of fitness or conditioning; traumatic injury; sprains and fractures, spinal cord injuries, bacterial infections; rashes; and the transmission of communicable diseases, including viruses of all kinds, bacteria, parasites or other organisms or any mutation thereof;
  • Premises: defective, dangerous or unsafe condition of the facilities; falls; collisions with objects or barriers that are a part of the premises; dangerous, unsafe, or irregular conditions on the ground, floor, ice, grass, turf or other surfaces; extreme weather conditions; and travel to and from the premises;
  • Use of equipment: mechanical failure of the equipment; negligent design or manufacture of the equipment; the provision of, or the failure by, the Organization to provide any warnings, directions, instructions or guidance as to the use of the equipment; failure to wear safety or protective equipment; and failure to use or operate equipment within my own ability;
  • Contact: contact with participants, equipment, machines and equipment, or other persons; and other contact that may lead to serious bodily injury, including but not limited to concussions and/or other brain injury or serious spinal injury;
  • Advice: negligent advice regarding the Activities;
  • Ability: failing to act safely or within my own ability or within designated areas;
  • Sport: the inherent risks of participating or volunteering in sport, including but not limited to slipping or falling on ice or the floor or ground; being hit with or tripping on sports equipment; dropping a weight, ball or other equipment onto any part of my body; and the malfunction of an exercise machine or other piece of equipment;
  • Conduct: my conduct and the conduct of other persons including any physical altercation between participants or volunteers; and
  • Travel: travel to and from the Activities

Cyber: The Organization may offer or promote online electronic form registration which has different foreseeable and unforeseeable risks than in-person registration. These risks include privacy breaches, hacking, technology malfunction or damage.

Negligence: The Organization may be negligent, which may include failure by the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with participating or volunteering in the Activities. (Does not apply to volunteers younger than 18 years old)

TERMS

In consideration of the Organization allowing me to participate or volunteer in the Activities, I agree:

  • that the sole responsibility for my safety remains with me;
  • that I am not relying on any oral or written statements made by the Organization or their agents, whether in a brochure or advertisement or in individual conversations, to agree to participate or volunteer in the Activities;
  • that I am responsible for my surroundings and the location and equipment that I select;
  • that my mental and physical condition is appropriate to participate or volunteer in the Activities and I assume all risks related to my mental and physical condition;
  • to comply with the rules and regulations for participating or volunteering in the Activities;
  • to comply with the rules of the facility and use of equipment;
  • that if I observe an unusual or significant hazard or risk, I will remove myself from participation and bring my observations to a representative of the Organization immediately;
  • h) the risks associated with the Activities are increased when I am impaired and I will not participate if impaired in any way;
  • that it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and accept the suitability and conditions of the Activity;

that COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death;

  • that I am responsible for choosing my safety or protective equipment and the secure fitting of that equipment; and
  • that negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities.

ACTIVITIES STATUS

I agree that the Organization has the discretion to cancel any scheduled Activities or modify the structure of any Activities due to a public health or safety issue, which may include removing specific disciplines or age groups from a competition, changing a competition format, or changing the manner in which individuals become eligible to participate.

I agree that the Organization may implement and enforce guidelines for participating or volunteering that may include adhering to ‘Return to Play’ protocols, signing declarations of compliance, or requiring that personal protective equipment be worn by participants and volunteers. The Organization has the discretion to remove any individual who does not comply with the Return to Play protocols, sign a declaration, or wear personal protective equipment. When required, I am responsible for providing my own personal protective equipment.

DISCLAIMER

I assume all risks arising out of, associated with, or related to, participating and volunteering in the Activities and waive any and all claims that I may have now or in the future against the Organization. I accept and fully assume all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from participation in the Activities. (Does not apply to volunteers younger than 18 years old)

I forever indemnify and release the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to, participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the Organization’s negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization. (Does not apply to volunteers younger than 18 years old)

The Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of participating or volunteering in the Activities. This Agreement is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall continue in full legal force and effect. I agree to file any lawsuit against the Organization in the Province of Ontario and further agree that the substantive law of the Province of Ontario will apply with regard to conflict of law rules. The undersigned hereby grants permission to use photographs/videos of me in print and in electronic media. The undersigned understands that once a photograph/video is posted on a website, the image can be downloaded by any computer/electronic user.

I accept the inherent risks of participating and/or volunteering in sport.

I accept that the Organization may be negligent

ACKNOWLEDGEMENT

I acknowledge that I have read and understand this Agreement, that I have executed this Agreement voluntarily, and that this Agreement is to be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. I further acknowledge that by signing this Agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.
