In making this application, I affirm that I am in good health, of sound judgement at all times and capable of participating in all Interlakes Community Center Pickleball Program activities. My participation is completely voluntary and I freely accept and fully assume all responsibility for all risks, and all possibilities of personal injury, property damage or loss to myself or any other person as a result of my participation in pickleball activities. I understand that there are physical risks involved in playing pickleball including, but not limited to injury related to rapid movement, falling down, being hit by balls or paddles, collisions with walls, nets and other players. I accept as my personal risk the hazards of such participation and will not hold the Interlakes Community Center Pickleball Program or its representatives responsible from any manner of claims or lawsuits that may result from my participation in the sport of Pickleball. I acknowledge that I use the properties and the facilities arranged for me by the Interlakes Community Center Pickleball Program at my own risk and I hereby hold harmless Interlakes Community Center Pickleball Program, the Executive, Board Members, Interlakes Community Center Pickleball Program Volunteers, Coaches, Instructors, other Members of the Association, and the owners of any such property and facilities from any suit, cause, action or claim resulting from my use of such property or facility, including Interlakes Community Center Pickleball Program meetings and/or gatherings, Interlakes Community Center Pickleball Program trips, gatherings and/or outings, presentations, seminars, training/skills workshops and/or local or other competitions. I waive all claims, known and unknown, that I have or may have in the future against the Interlakes Community Center Pickleball Program including the directors, volunteers and other members. I release and forever discharge the Interlakes Community Center Pickleball Program from all liability for any personal injury, death, property damage or loss resulting from my participation in pickleball activities due to any cause, including but not limited to negligence (failure to use such care as a reasonable or reasonably prudent and careful person would use under similar circumstances), breach of any imposed bylaw, breach of contract or mistake in error of judgement of the Interlakes Community Center Pickleball Program. I hold harmless the Interlakes Community Center Pickleball Program from all actions, proceedings, claims, damages, costs demands, including court costs of a solicitor and own client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with my participation in pickleball activities. I acknowledge that I have read this agreement and understand it, that I have executed this agreement voluntarily and that this agreement is to be binding upon my heirs, executors, administrators, representatives, assigns and myself,
