LLOYDMINSTER PICKLEBALL ASSOCIATION

RELEASE, WAIVER AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

In consideration of being permitted to participate in a pickleball tournament, league, clinic, event, program, or other activity organized or operated by the Lloydminster Pickleball Association (LPA), and/or to use any facility, property, equipment, or services associated with such activities, including facilities operated by the City of Lloydminster, I agree to the following terms:

1. ASSUMPTION OF RISK

I understand and acknowledge that participation in pickleball and related activities involves inherent and other risks, including but not limited to falls, collisions with other participants or equipment, slips and trips, injuries resulting from the use of courts or facilities, overexertion, strains, sprains, fractures, serious injury, permanent disability, or death.

I voluntarily assume all risks associated with my participation in LPA activities and my use of any associated facilities, equipment, or property, whether such risks are known or unknown to me.

2. RELEASE AND WAIVER

To the fullest extent permitted by law, I release, waive, and forever discharge the Lloydminster Pickleball Association, its directors, officers, volunteers, members, employees, coaches, instructors, organizers, representatives, agents, and affiliated organizations, as well as the City of Lloydminster, its employees, representatives, agents, and facility operators (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, expenses, or liabilities arising out of or relating to my participation in LPA activities or my use of associated facilities or equipment.

This release applies to claims arising from personal injury, illness, death, property damage, or other loss, including claims arising from the negligence of any of the Released Parties, to the extent such release is permitted by law.

3. RULES AND DIRECTIONS

I agree to observe all posted rules, warnings, policies, and safety requirements and to follow reasonable instructions provided by LPA directors, organizers, volunteers, coaches, instructors, facility staff, or other authorized representatives.

I understand that failure to follow rules or instructions may result in removal from an activity or facility.

4. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any claims, demands, actions, damages, losses, costs, or expenses arising from my negligent, reckless, or willful conduct, or from my breach of this Agreement.

I further agree to be responsible for any damage to facilities, equipment, or property caused by my negligent, reckless, or willful actions.

5. MEDICAL TREATMENT

I understand that LPA and its representatives are not responsible for providing medical treatment. In the event of an injury or medical emergency, I authorize reasonable emergency assistance to be obtained on my behalf when necessary. I understand that I am responsible for any costs associated with medical treatment or emergency transportation.

6. PERSONAL INFORMATION AND EMERGENCY CONTACT

I consent to the collection and use of my personal information by LPA for purposes reasonably related to the administration and operation of its programs, events, tournaments, memberships, communications, insurance requirements, and emergency response.

7. PHOTOGRAPHY AND VIDEO

I grant the Lloydminster Pickleball Association and its authorized representatives permission to photograph and/or record me during LPA activities and events.

I authorize LPA to use such photographs or recordings for legitimate promotional, educational, informational, and organizational purposes, including websites, social media, promotional materials, newsletters, and other publications, without compensation.

8. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the applicable laws of Canada.

Any dispute arising from or relating to this Agreement shall be subject to the jurisdiction of the courts of Alberta, unless otherwise required by applicable law.

9. SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be severed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

10. ACKNOWLEDGEMENT AND VOLUNTARY AGREEMENT

I confirm that I have read and understood this Agreement and have had a reasonable opportunity to ask questions and seek independent legal advice before signing.

I understand that by signing this Agreement, I am giving up certain legal rights, including the right to make certain claims against the Released Parties.

I am signing this Agreement voluntarily and without pressure or duress.

I acknowledge that I am physically capable of participating in the activities for which I am registering and will inform LPA or the appropriate event representative of any condition that may affect my ability to participate safely.

BY SIGNING BELOW, I CONFIRM THAT I HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS RELEASE, WAIVER AND INDEMNITY AGREEMENT.
